Hi, not sure if this is a dormant fly trap. In if so when should it be taken out of dormancy.

It doesn't look dormant. Also, flytraps aren't really ever "taken out of dormancy." It is a natural process that happens with the changing of the seasons. As the days get longer and warmer, flytraps start growing again.

Also, that plant doesn't appear to be getting sufficient light to be at its healthiest. If at all possible, give it full sun. If it is freezing or frosting where you live, try to move it outside on days when it is above freezing.
